BOOKING INFORMATION:

• Please note that it is important you are aware, look out and understand how the booking procedure happens in our studio. Your deposit ($100) is to secure your session with us, which will be deducted from your chosen packages later.
• Full Payments must be paid on the day of shoot if you are paying cash or a day before if you are paying by card.
• Packages are clearly set out and there are no hidden costs to you
• Based on your questionnaire in regards to colours, We will set up to shoot.
• Please Note: If you have any special requirements regardings poses, props, backgrounds or to recreate an image you like or you have seen something you like please let us know at least 1 week prior to the session. We will try our best to incorporate that. So if we have not received any information, then we will plan ourselves and we will not be able to change anything on the day of shoot.
• We will also need photos of people who are going to be photographed and their outfits at least one week prior to the session so we can choose backgrounds and props accordingly. We will do all the setups a night before the session. So if we have not received any information that we have requested for, then we will plan ourselves and we will not be able to change anything on the day of shoot.
• JS Photography Studio has a certain style and way to photograph babies and families so it is important as a client that you understand by booking JS Photography Studio you will be getting similar to our previous work
• NOTE: NO ACCESS TO TOILET AND BATHROOM FACILITY! Unfortunately, there is no access to a toilet or bathroom due to the studio being in a converted garage and public liability insurance does not cover clients within the home. As it’s inside it is not deemed safe for both parties. Therefore you would need to make sure you are aware of this and prepare to go beforehand. There is a local shopping centre that has toilets. We apologise for any inconvenience.

General Information:

To make the session run quickly and smoothly we ask you to do the following:

• Feed your baby before the session
• Make sure the diaper is clean
• Have a pacifier/dummy even if your baby doesn’t use one
• Bring in extra milk if not breastfeeding
• All the family members who are going to be photographed must come dressed up from home as we do not have any facility to get dressed in the Studio.
• Family can change maximum of 2 outfits
• Keep your belongings in your bag and do not spread them out in the studio
• Stay seated to one end of the studio at all times until requested

PHOTOGRAPHY STUDIO POLICIES & CONDITIONS:

1. It is understood that ‘JS Photography Studio’ is the official exclusive photographer retained to perform the photographic services requested on this contract
2. The photographer has the right to use these images under this contract for advertising, display, publication or other purposes of the persons in these photographed unless they tick the ‘Disagree’ in this contract in the ‘Image Consent’ section
3. All images created by ‘JS Photography Studio’ that includes digital images, negatives, prints, products and previews remain the exclusive property of ‘JS Photography Studio’
4. CANCELLATION / DEPOSIT POLICY: We ask for a deposit of $100 ( Non- Refundable ) to secure the time and date of your session which will be adjusted in your chosen Package later. If for some reason you have to cancel your session, the booking fee will not be refunded , however you can reschedule once. We request 24 hrs advance notice to reschedule .
5. LATE POLICY: If you arrive late on the day of your session, that time will be taken away from your session as the photographer needs to start, finish at that specific time. If you are more than 30 minutes late, we will need to cancel the session. Your deposit won’t be reimbursed and you need to book a new session.
6. In the event of the photographer being sick, an unwell photographer has the option to reschedule the session up to 2 hours before the session. Usually being fit for the session is best, as a photographer avoids being sick around any newborn/ clients.
7. If a studio/photographer cannot go ahead with the session due to weather, an act of God, strike or anything out of control or emergency, the photographer is entitled to reschedule your session. No refund will be given.
8. If the newborn is unsettled, does not seem well, Photographer has the permission to dismiss the session and refuse to continue to avoid having the newborn/child become sick or not feeling well. If it happens the client has to pay full session fee as we tried our best to get the shoot done.
9. If your child has had a rough start to life like at birth, has a medical condition and/ or has a disability or special needs. It is extremely important that you bring it to our attention before booking the session, if this occurs after your booking you let us know.
10. In some cases where a newborn/child isn’t fit or well to be photographed, we will not proceed. But it is your responsibility to let us know. If you think your newborn/child is ok to come in for their session and they have been unwell, sick or anything of this kind then the Photographer holds no responsibility if anything may occur during or after your session. It’s your duty as the parent to take this decision to bring your child in or not.
11. The photographer is not responsible for any newborn/ children/persons during the session left unattended and it is the client’s responsibility to take care of the children during the session to avoid tripping over or hurting themselves as during the session it may get messy with props and items left on the studio floor
12. NO alteration will be made to this contract.
13. No video/photographing on phone.
14. Please do not bring extended family or more than two adults unless it’s been discussed with the photographer.
15. We do not tolerate any misbehaviour, bad language or abuse from clients and if any such things occur we do take matters seriously by calling the police or asking you to leave the premises. If you have or are having a boy, please DO NOT CIRCUMCISE your child before your session. We will be swaddling your baby tightly while he is naked, and moving him from one position to another constantly during the session. This is very painful for a child who has just been circumcised. We will NOT photograph a newborn who has been circumcised less than 6 days before the session.

16. In any dispute or in the event you or your family become injured during the session or while in the studio, JS Photography Studio is not held responsible or liable for injury to you or your family. We ask you to be cautious and be seated when not being photographed.
17. CAKE SMASH SESSIONS: Please advise us when booking if your child has any food allergies as we provide the cake, you must let us know at least 1 week prior to your session. Also, after cake smash kids get messy so you have to wipe them off as we do not have any washing facility.

IMAGES, PACKAGES AND DELIVERY

1. No viewing and selection will be done on the day of the photoshoot. We will select the best images taken, upload them to an online gallery within 7 days from the shoot not edited for you to select.
2. You will have 3 days to select the images or a further $50 fee will be applied, as per contract. Once images are selected no changes can be made. No swaps of any images.
3. After receiving your selection the Final gallery will be delivered in 3-4 weeks. Final Images will be delivered online via pixieset for you to download.
4. Additional images can be purchased at $30 each for the first five additional images and $20 each afterwards.
5. Please Note : We do not provide any unedited photos Images will only be kept in the archive for 3 weeks after final delivery, then it will be automatically deleted from our system after that you will not be able to make a further purchase and if you lose your photos after final delivery in your system then we won’t be able to retrieve the gallery.

6. All packages are subject to change, but packages at the time of your booking will still be valid.
7. All images are professionally retouched and no additional editing, alteration to any images created by the photographer is allowed to be done without the photographer’s permission.
8. Images are edited to the like, style and work of the photographer.We enhance colours and contrast, minimise shadows, and straighten and crop. We do not apply heavy editing such as removing people or objects from the background, making your appearance different or any additional body shaping, nail polish, flyway hair etc. We also do not alter clothing such as ironing wrinkles, etc. So please plan accordingly to be photo-ready.
9. Reorder of a USB due to being lost or misplaced will incur an additional $60 fee payable to the photographer
10. Any USB and/or products needed to be posted to you will incur a quoted postage fee quoted by the studio. USB’S and/or product are available for pick up

COPYRIGHT TERMS & CONDITIONS

1. It is illegal to redistribute these photographs for profit or use other than private consumption without ‘JS Photography Studio’s permission. Violators of this federal law face severe criminal and civil penalties.
2. All images are given in JPG Format. No images are given un-edited under any circumstances.
3. The Copyright Act protects photographers by giving us the exclusive right to reproduce your photographs. Violations include, but are not limited to, making illegal copies, scanning, printing from home or downloading from our website. It is illegal to copy or reproduce these photographs in any manner without our permission and violators of this Federal Law will be subject to its civil and criminal penalties.

IMAGE CONSENT:

1. In a digital age where businesses like ours depend on social media for booking other clients, we aim to share images, videos of the session online on social media and websites.

We understand some clients prefer not to, and as we respect people’s privacy it’s important to note that all newborns look similar and will not be identifiable. We do not mention the names of clients, or children in any of the images.
